Privacy and Terms
How Forex Plus Australia Pty Ltd handles your information and the terms under which our website and services are provided.
Privacy Policy
Forex Plus Australia Pty Ltd (ACN 098 382 202, "we", "us") is bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy explains how we collect, hold, use and disclose personal information. Last updated 9 October 2026.
What we collect
- Enquiries: your name, email address, phone number (optional), approximate annual FX volume and the content of your message when you use our contact form.
- Client accounts: your email address and a securely hashed password when you register for our client area.
- Identity and transaction documents: when documents are uploaded for verification (for example financial instruments, payment messages and passports), the personal information they contain, including names, passport numbers, nationality, date of birth, sex, passport expiry and issuing country, and the results of our checks.
- Customer identification: information we must collect to identify and verify customers under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (AML/CTF Act).
- Technical information: IP address, browser type and the pages you request, which our servers and security providers log when you visit the site. We use cookies to keep you signed in; we do not use advertising or analytics cookies.
How we collect it
We collect personal information directly from you where we reasonably can: through this website, by email, by phone and in documents you give us. We also collect it from third parties such as introducers, brokers and counterparties who send us documents about you, and from public and commercial sources such as sanctions and politically exposed person (PEP) lists. If we receive information we did not ask for, we will destroy or de-identify it unless we are permitted to keep it.
Why we collect, use and disclose it
- To respond to your enquiries and provide our foreign exchange services.
- To identify and verify customers and screen parties against sanctions and PEP lists.
- To assess whether documents and instruments presented to us are genuine, and to detect and prevent fraud, money laundering and terrorism financing.
- To meet our legal and regulatory obligations, including under the AML/CTF Act and our Australian Financial Services Licence.
- To run, secure and improve our website and systems.
- To tell you about our services. You can opt out of marketing at any time by replying to the message or contacting us.
If you do not give us the information we ask for, we may not be able to respond to you or provide our services. You can browse this website without identifying yourself, but the law does not allow us to deal with customers anonymously.
Who we disclose it to
We disclose personal information only for the purposes above, to:
- service providers who host our systems, send our email and protect our website;
- sanctions and PEP screening providers;
- banks, payment providers and counterparties involved in a transaction you ask us to carry out;
- our professional advisers, auditors and insurers; and
- regulators and law enforcement agencies, including AUSTRAC, ASIC and the police, where the law requires or permits it.
We do not sell personal information.
The indicative exchange rates in the worked examples on this website come from Open Exchange Rates. Our servers request the rates directly; we do not send Open Exchange Rates any personal information, and your browser does not connect to it when you view a page.
Overseas disclosure and storage
Some of our service providers are located outside Australia. Personal information is likely to be held or disclosed in:
- Singapore, where our website and database servers are hosted;
- the United States, where our email delivery provider processes messages;
- Germany, where our sanctions screening provider receives the names, dates of birth, passport numbers and nationalities we screen; and
- other countries where our content delivery and security network operates.
We take reasonable steps to ensure overseas recipients handle personal information consistently with the APPs.
Automated processing
We use computer programs, including an AI model running on our own servers, to read uploaded documents, extract identity details, screen the people named in them against sanctions and PEP lists and assess whether an instrument appears genuine. The program uses the personal information in the documents and the screening results. Its output substantially assists our decisions about whether to accept an instrument or proceed with a transaction. A staff member reviews the output before we make that decision.
How we hold and protect it
We hold personal information electronically in access-controlled systems. Passwords are stored as one-way hashes, traffic to this site is encrypted, and uploaded documents are processed in an isolated environment. We keep personal information only for as long as we need it for the purposes above or as the law requires, including the record-keeping periods under the AML/CTF Act (generally seven years), then destroy or de-identify it. If a data breach is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) as the Notifiable Data Breaches scheme requires.
Access and correction
You can ask for access to the personal information we hold about you, or ask us to correct it. We will respond within 30 days. We do not charge for a request, but may charge a reasonable fee for providing access. We may refuse access where the law allows or requires it, for example where giving access would breach the AML/CTF Act. If we refuse, we will tell you why in writing.
Complaints
If you think we have breached the APPs, please contact our Privacy Officer. We will acknowledge your complaint promptly and aim to resolve it within 30 days. If you are not satisfied with our response, you can complain to:
